Suppose Mr. Varelst has every Month desired his Attornies to sue and being neighbourly Men they would not. Would that preclude the Plaintiff from his Action.
That the Defendant at the establishment of the Court were here, is immaterial.
The Stat. of Limitations comes next, and brings up the Rear of these Pleas.
