This is an Action on the case against the Defendant as security, by an indorsement on a Bengal Note for Money Lent to Collysunker Surmono.
The Note, and the signature of the Principal, and of the Defendant the Security was proved; and the Demand of payment from both before the Action was brought.
The Defendant had Mortgaged his Potah of Land in One of the ways usual among Bengallees, using the words “if the Money is not paid at the day I will sell the Land and Pay” No objection was taken on account of this Mortgage of the Potah. And this Mortgage
