application to a Judge at his chambers, that Mr. Justice Hyde, to whom such an application had been made, knowing privately though not judicially that Mr. Colebrooke the Defendant is collector of Calcutta, thought he ought to require from the Plaintiff a fuller affidavit, stating the cause of action & so many of the circumstances as would shew that it was not brought for any act done in the collection of the revenue according to the usage of the country or the Regulations of the Gov: Genl in Council.
Mr. Justice Hyde’s doubt was founded on the [ILL] which is in these words. And be it further enacted, that the said Supreme Court shall not have or exercise any Jurisdiction in any matter concerning the
