the fence, which the Chief Justice inclined to think was so near that the Prisoner had not used proper caution such as a good and prudent Man ought to use, before he fires a Gun in such a place. And he directed the Jury if they were of that Opinion to find the Prisoner Guilty of Manslaughter but if they thought there was no want of due Caution, they should find him Guilty of killing per Infortunium.
