By the Court was that the Plaintiff should pay to Colonel Pearse and the other Defendants who were made Defendants only for form their Costs, and should recover against the others who were the Material Defendants, those Costs, and also the Plaintiff’s own Costs. Mr. Dunkin Advocate for the Defendants admitted the Decree was so pronounced, on which, and on his Consent, the Decree was amended.
