Mem: I intend writing on this and the following pages a Short State of this Cause Sir E. Impey & Cator v the Company with the reason on which Sir Robert Chambers and I [John Hyde] had agreed that the Plaintiffs must suffer a Non-Suit, which would have been the judgment of the Court in the Fourth Term 1780, if the Plaintiffs had not prevented that Judgment by discontinuing their Action in the Vacation, on Oct. 16th 1780 just a Week before the Fourth Term began, which was on Monday Oct. 23d 1780.
