There was sufficient Evidence without Mr. Bird.
Mr. James Start, Chirurgeon, was in Court by desire of some Person on behald of Mr. Bird, to prove that Mr. Bird was so ill that he could not attend, but Mr. Johnson having told me, it was not intended to call Mr. Bird, on the part of the Prosecution. I called on Mr. Dunkin, who was Advocate for the Prisoner, to say, whether he had any thing to move concerning Mr. Bird, and Mr. Dunkin saying he had not, I told Mr. Stark, he had no occasion to stay.
