An Action on the Case.
There are on the Record Three Counts, For Money received by the Defendant for the use of the Plaintiff, One Hundred and Eight Sicca Rupees, Nine Annas, and Nine Pice, was the Count principally relied on. The other two Counts were for the same Sum, as Money Lent by the Plaintiff to the Defendant; and as Money laid out by the Plaintiff for the Defendant.
To this Plaint the Defendant pleads Non Assumpsit, and on this Issue is Join’d.
The Defendant has also given a Notice of Set-off.
