1781. 2 Sittings. [Thursday] April 5.

The Rent was to be paid for a Navigable Canal which runs under Surmans Bridge at Kidderpore, and is the Boundary of the Town of Fort William to the Southward. The Plea was Non infregit Conventionem. This is an admission of the Deed of Covenant, and therefore it was not proved.
A Witness for the Plaintiff, proved the Defendant was put into possession of the Canal, that is into the receipt of the Profits which are a Toll on all Boats going along the Canal, which Toll was granted to Major Tolly by the Governor-General and Council, for his having made a Navigable Canal, or rather having improved the Navigation of a small River or Nullah which runs from the Salt Water Lake, into the River to the Southward of the New Fort.
The Rent remaining in arrear was proved to be Eight Thousand Four Hundred and Seventy Three Rupees.
Mr. Davies desired to have Interest given for this Sum, but Impey said, Did you ever know Interest given for Rent? And refused
