Mr. Strettell, argued that the Dutch Bonds, were consider’d as Bank Notes, and the property pass’d, by meer possession, without indorsement, and that the value could not be recover’d in this Action as money had and received by the Defendant, to the use of the Plaintiff, because the Plaint conveyed no notice of what the demand was.
