in effect dismiss’d the Bill against the fourth, for they are a Corporation or if not a Corporation they are joint Trustees, and must be jointly sued.
I was much at a loss to find that palpable perjury which Mr. Davies charged on Bonifacio. But I found it was that on December 5th 1786 he denied he had notice of the Subpoena, but he said truly for by the Evidence of Mr. Smoult in this Cause it appears the Subpoena was not deliver’d into the Sheriff’s Office untill December 6th 1786.
