Two or more Statutes which may have an effect in different modes or degrees on the same species of Offence they ought to be pleaded with this distinction, first where a Statute is continued revived or refer’d to, by a subsequent Statute, without any material addition or alteration, the pleadings ought to conclude against the form of the first Statute – but where ever any material alteration
