Last Term: Mr. Brix moved to strike out of the Plaint the names of the same Defendants, which be called an amendment, leaving the name of One Defendant who had appeared.
But the Court inclined to think, such an amendment could not be made in an Action at Common Law, and desired Mr. Brix to look if he could find in any book a Precedent of that sort of Alteration allowed by the Court of King’s Bench.
The Court said it seemed not to be an amendment, but altering even the name of the Cause. Mr. Brix, withdrew
