Bearers ought not to have been admitted to give Evidence, and that therefore the Verdict should be set aside, and the Defendant should have a New Trial. The Lord Chief Justice doubted this Opinion, and while the Court took time to consider on it, the Defendant Mowjeram had been suffer’d to go at large under Recognizance, but several times on being call’d has not appear’d, and it is supposed he is absconded or is dead.
