Mr. Justice Hyde; I am of the same Opinion, that after this promise, the Confession ought not to be given in Evidence unless it can be understood that the promise made by Mr. Plowden has been perform’d, by the Prisoner not being prosecuted with the utmost severity the fact might admit. He is only prosecuted for Grand Larceny, whereas it is probable the fact would have admitted his being
