An action to recover Money on a Bengal undertaking to produce a Debtor or to pay the Money, but there being no Consideration alledged in the Plaint, there was a Non-Suit.

Mr. Sealey Open’d that Mr. John Sumner having by confinement and flogging extorted from the Plaintiff Five Thousand Rupees, the Defendant who was Mr. Sumner’s Banyan thought it a good way of getting Money and by the like means, making use of Mr. Sumner’s Sepoy’s Hircarrahs & Peons, forced the Defendant to pay first One Thousand Rupees, afterward another Sum of two Thousand, and at several times other Sums, which this Action is brought to recover as Money received to his use.
The taking the Money by compulsion by Imprisonment by Sepoys and Hircarrahs was proved.
