It seem’d to Mr. Justice Hyde that the Motion ought to have been, only to stay the Execution, and that the Plaintiff ought to have been permitted to go on to Trial in the Cause and to obtain Judgment, but it being said that in this Court the Rule was otherwise, and that particularly the Court had done otherwise, in a late case of an Action, in which Harvey was Plaintiff, against Jackson Defendant. And a Bill for an Injunction filed by Mr. Jackson the Register, therefore
