1779. 1 Sittings. [Friday] Feb. 5.

sign’d by the President of the Calcutta Committee of Revenue, and dated in the year 1778, which purported, as those Pottahs usually, if not always, do, a present Grant, at the time of the date, yet possession being proved to have been deliver’d, at the time of the Sale, Impey was of Opinion, the Pottah should have relation to the time of the Sale, and he said he had known many instances of Cases resembling it in England where the Deeds had been executed in Court, and yet were held to relate to the commencement of the Title. Chambers and Hyde assented to the propriety of this Pottah having relation to the time to the time of the Sale, and that therefore the Plaintiff had now proved a compleat Title.
The real dispute was the boundary on the West Side, the Defendant claiming the Ground adjoining to his own, which was confessed to be ground lying West-ward of the Cutwally House. The Defendant claim’d the Ground close to the Cutwally House, the Plaintiff said the Boundary was a Ditch a few Cubits to the West of the Wall. Judgment for the Plaintiff.
