The Justification, was much more concise than Ordinary, and was in the words following.

Raddakissore Segono} On reading an affidavit of [ILL]

Baboo Khawn } It is order’d that the Defendant in this
Cause be at liberty at the Trial of this Cause to give the following special matter in Evidence by way of Justification that is to day [ILL] the several acts Complained of by the said Radakissen Segara as Trespasses were no Trespasses but acts [ILL] by him the said Baboo Khawn in his official Capacity of Nazeer the Khalsea in virtue of Certain order Issued to him by the Governor General and Council of Fort William aforesaid directing him to destroy Certain unauthorized Bazar or Public Market Erected without the License of the Governor General and Council of Fort William aforesaid without whose License it was unlawful to erect the same and that the said Baboo Khawn was Nazeer of the Phalsa a well Known Public officer in the Town of Calcutta and Factory of Fort William aforesaid that in doing the acts Complained in this Cause on Trespass he acted in the Discharge of his Duty and as it was Lawful for him to do and not otherwise upon the motion
