to the Jury said that it was not proved that the prosecutor was taken by legal process, but if it had been so, yet the abuse of the process (if in truth at that time there was any process) would make it an Indictable assault and imprisonment, for it was an abuse to carry the Prosecutor to the House of the Prisoner, instead of carrying him to the Sheriff, which ought to have been done, if he was arrested, and every imprisonment implied an assault.
