Revenue or concerning any act [ILL] ordered or done in the collection thereof, according to the usage and practice of the country, or the regulations of the Governor General and Council.”
In the matter now before the court the only grounds on which we can form regularly any opinion are the abovementioned certificate and affidavit. The certificate, as usually, asserts nothing more than that a plaint has been filed in an action thus entitled: It may, for aught that appears, be an action of Debt on a bond, or any other kind of Suit. The affidavit is also in the usual form; and there is nothing either in that or the certificate which can lead us to suppose that this action is brought against Mr. Colebrooke in his official capacity, for any act ordered or done by him in the
