he was unable to pay the Money due for the third Quarter, he excused himself by the General Scarcity of Money, not by the allegation of Usury, or of extortion, or of hardship in the Bargain.
643 Cro. Eliz. The distinction is, between what is really a Wager and a Shift to make a loan appear like a Wager.
The bargain was not a loan, but a purchase.
