Lessor of the Plaintiff claims the small peice of Ground in question which is cover’d by the Veranda of a house, as part of his purchase of the Cutwally Prison with it’s appurtenances.
The Plaintiff in support of his title produced no Pottah, and his advocate admitted he had none; but he produced an English Paper dated 31st day of March 1774 with a Seal, with the Cross &c and the Letters “Engl. E. Ind. Company” on it, and said in the writing to be the Company’s Seal, and sign’d by Mr. Hastings, Aldersey, Dacres, Lawrell, Goodwin, Graham & Grueber; and also in another part sign’d Robert Dobinson, Auctioneer” Mr. Hastings and the others were then President and Council, and the Writing Purported to be a Certificate that they had authorised Dobinson to sell this Ground by public auction, and that
