1778. 4 Term. Friday Oct. 31st.

Saturday Oct. 31st 1778.
Present
Mr. Justice Hyde.

A few common motions.
After those the Ecclesiastical matters were call’d on.

In the Goods of Ambrose Rocke, deceased.
James Dolman, and Samuel Oldham contend which shall be administrator of the Goods of Rocke.
Dolman states himself to be a creditor in 320 odd Rupees, Oldham swears “the Estate of the deceased was indebted to him about 350, odd Rupees”

I doubt whether the Charter obliged us to grant administration to the greater Creditor, and inclined to think it were better if it did not.
I put off the hearing with Liberty to both sides to make fresh affidavits, filing them four days before the hearing.
