This is an Action of Trespass for breaking and entering Land the “property” of the plaintiff and pulling down a House.
Impey, Took objections to the Plaint and particularly, that it was not sufficient to alledge, as in the first Count, Land the “Property” of the Plaintiff, but it must be alledged and proved to be in his possession: yet the other Counts he thought might do, and therefore suffer’d the Plaintiff to call his Witnesses to prove the Trespass.
Lilly’s Entries 459 Graham against Howard was produced to shew that the Plaint was according to that Precedent.
