There was a long affidavit produced, of the circumstances of the Case, which Sir Robert Chambers said ought to be annexed to the Bill, and thereon a short affidavit was sworn that the Persons named in the Bill, and in that affidavit, were going to Sea, and that their Evidence would probably be lost as they were going to England in the Ship Berrington – Captain Ley, as the Witnesses had inform’d the Deponent.
And on this affidavit the Court order’d the Witnesses to be examined and interrogatories for that purpose to be filed, although the Company had not yet answer’d the Bill
