The Common Ejector were staid on the usual Terms, on the filing this Plaint.
But Mr. Litchfield refused to enter an appearance for the Defendants returned non [sunt] inventi, by Mr. Johnson the Plaintiff’s Attorney, because the Prothonotary was of Opinion he had not right so to do, for the Prothonotary thought the Summons in the new Cause, was the notice of the filing the New Plaint meant by the Rule of this Court.
