The Court doubted, at first whether Administration could be granted to Mrs. Smith, because on reading the Will it appears she has an husband living, but on consideration the Court granted it, on the Authority of a Case in Burn’s Ecclesiastical Law, Vol. II – Page 639 Quarto Edition, Printed in 1763 – the Case there cited is Brown & Wood Hilary 23d Car – in Alleyn 36 – Style 74, 75.
Mrs. Smith appears by the Will to be the Legattee of all the effects of all the effects of Captain Dickson, or of most of them. The Executors named in the Will renounced.
