At the time he moved for the Rule to shew cause, stated, and now on moving to make an absolute Rule, repeated, that it was a Motion considered in the Court of King’s Bench as of Course, and was never refused.
Mr. Brix, Thought as Advocate for the Defendant he admitted the Service of the Rule, informed the Court he did not appose the Motion.
Mr. Davies was not concerned in the Motion, but had been Advocate for the Defendant, however he said on a former occasion he had looked into books, and it seemed to him to be treated as a Motion of Course, always granted when applied for.
