to each of which are subjoined two averments, first that the Deft is subject to the Jurisdon of the Court by having committed the offence in Calcutta, and 2dly that he is subject to the Jurisdiction, by being a Brtiish subject resident in Bengal.
1. Count – charges the Deft with having on the 7th of Septr last made an assault upon the prosecutor with a drawn sword with an intent to kill him.
2 Count, charges Deft with having broken & entered the dwelling house of the Prosecr and having assaulted beat & struck him with a drawn sword on divers parts of his body, with intent to kill him, & with having thrown his goods (which are specified) out of the house & broken & destroyed them.
3d Count charges him with a common assault & battery.
