Mr. Just: Hyde came immediately after the determination of the following motion.
In a cause wherein Shah Md & Sheik Khoda Buksh are Plfs & Garib Ullah Jam is Deft.
On the 27th inst: Mr. Davies for Deft obtained a Rx to shew cause why all proceedings in this cause, since the 1st Writ of Ca: sa: issued, – vis an alias causa, a scire facias agt Shah Mahd & Ramjany the bail in this cause, and a ca: sa: agt them, should not be set aside; and the bail be discharged out of Custody. And leave is given to file an additional affidavit giving to Plf’s atty a copy thereof.
Mr. Davies now moves to make the Rx absolute.
