only used the name of R. G. M. to keep his own secret. This is an inconsistency which throws a suspicion of partiality upon his Testimony, though it may not be intentionally false.
I rely upon it as a point of Law that the accot C. is an unsettled Accot & no ground of an action.
I further insist that the entering into an agreement to submit to arbitration is a new assumpsit, which puts an end to the old one; on the authority of a modern case – Hite v Chaplin.
