The Case proved was that Charles Muns the Defendant had agreed with Giles Avery a Shipwright to buy a Sloop from Avery and to pay, at the end of the Six Months, and it was agreed that George Begg should give security for Muns, by accepting a Bill of Exchange for Twelve Hundreds Rupees drawn by Muns to be paid at the end of Six Months to Avery, by Begg. About a Month after Muns had sign’d this Note Avery had desired Begg to discharge
