What was most contested by the Defendant of the Sums demanded by the Plaintiff as Damages, was the Value of the Insurance between Bengal and Madras which he calculated at the rate of Three and an half per Cent: but for the Defendant it was insisted that he was not entitled to this because no insurance of the Gunny Bags had actually been made, however as the Defendant had ben himself liable to that risk the Court thought he was intitled to consider that as part of the Value to him of the Goods which
