Mr. Morse, Moved for four days further time, to give notices of Justification in the three Causes against Mr. Peat for assaults; two days time given by consent of the Advocate for the Plaintiff, on leave being given by the Court that the Plaintiff might sit down the Cause in the last day of the Term, if he thought fit. The Court agreed that if the Plaintiff did not try the Causes at the Sittings he must pay the Costs of not going on to Trial according to Notice, because by the Rule made before for ten days time, it was order’d that the Defendants should then take notice of Trial
