Now I come to my fourth General Proposition.
The Intention is not Cognizable by the Court because it is not Issuable.
88 Jenkins – the Law does not punish for the Intention to do ill except in the case of high Treason.
In this plea an intention only is stated: no act is alledged to be done.
6th Mod: 99. To advise to do an ill thing is not Punishable.
