And that if it were put off it must be on payment of Costs. Hicky desired Mr. Uvedale to prepare an affidavit, and while Mr. Uvedale was writing it, Hicky said to the Court that Mr. Uvedale told him the Costs of putting off the Trial would be Ten Gold Mohurs for this day, and that he could not afford it: Sir Em Impey then said, if he could not afford to pay Costs, he must make a proper affidavit to be admitted a Pauper.
This Hicky declined doing and said he would rather the Cause should now go on and it did so.
