leading Advocate for the Defendant, desired leave to withdraw the Demurrer, and to Plea to the Action. To this it was objected by Mr. Davies that by this Demurrer the Trial was delaid and there could not be a Trial in the Sittings this Month, and Judgment next Term, and therefore the Court ought not to give this permission, unless the Defendant would consent to plead so soon that the Trial might be as soon, as if the Plea had been as early as it would have been, if the
