this kind of defence appears often very unjust in the Defendant, yet the Law allows it, not for the benefit of the Defendant, but as necessary for the maintenance of the Policy of the Law.
I (Sir Robert Chambers) agree with the compiler of the Latter Volume of Bacon’s Abridgment where he says, it seems now to be settled that if the act to be done is illegal, there is no difference whether the Contract be under seal or without Seal.
