To have been brought, and if not the Court will discourage such Actions by giving small Dammages, but in the present Case, we are not driven to that consideration, for the aggravation, which is that Mr. Lyon sent for a Man not hired by him, and flogged him for refusing to Work for him appears to me to be supported by Perjury, and for that Conduct in the Plaintiff he deserved to be punished by having very small damages, and no more Costs that Dammages.
