Possession of the Fort: And the Court were of Opinion that by not delivering the Fort, the Defendant failed in his Agreement to Deliver the Jaggheer, Purgunnah or Land, and by his express Agreement was bound to refund the Money had had received.
The Advocates for the Plaintiff asked for Interest, but the Court said no Interest could be recovered on such a Contract.
Judgment for the Plaintiff.
