Mr. Davies relied on these circumstances, and observed that an honest & scrupulous Plf might be afraid to swear that the act of which he complains was not done in the collection of the revenue according to usage &c, though such was his persuasion or belief, because the question whether it be such an Act is a question of law.
On the whole though I did not disapprove Mr. Justice Hyde’s caution, yet as the Plf now claims by his counsel in an open Court a writ of Summons
