5. An affidavit of Mr. Charles Rice who says that as the Deft’s dem he hath made frequent application to The Lloyd to enter up satisfaction on record. That Lloyd always acknowledged he had received the amount of the Judgement & costs. That he at one time said Plf was absent from Calcutta, & promised that on Plf’s return he would cause satisfaction to be entered on the record of the said Judgement and by such promises and other like pretences and excuses hath put off and delayed the said Defendant from the said month of March to this present period but without any ways securing the said Defendant or entering up satisfaction on the Record: Thomas Lloyd told this Deponent that the whole amount of the Judgement and Costs in this Cause were assigned to him the said Thomas Lloyd by Juggomohun Roy the original Plaintiff in this Cause for a just and valuable Consideration, and as a proof thereof did produce, and shew to this Deponent, a paper purporting to be a Deed of assignment, executed by the
