assault upon on Goosia, at Dinapore in the province of Behar, with a certain sharp iron instrument called a Bayonet, (val: 1 shil:) which he held in his right hand, and wih having therewith feloniously &c struck & wounded the said Goosia on the left side between the 3d and 4th rib, giving him thereby one mortal wound, (6 inches deep, 3 inches broad) of which in the sd 8 July he instantly died. And so the indictment charges the prisoner with having feloniously willfully & of mal: aforethought killed & murder’d the said Goosia. To this are added two averments. 1st that at the time of committing the felony and Murder aforesaid the said James Clarke was in the service of the said United Company and therefore is a person subject to the Jurisdiction of th Supreme Court of Judicature at Fort William in Bengal aforesaid. 2d that at the time of committing the felony and Muder aforesaid the said James Clarke was a British subject
