Was first made on the Principal before the Security would be liable but to this it was said the Evidence afforded two answers. One that the Defendant the security had waved this, by saying the Money need not be demanded of the Principal, but he would pay it. And the other that the Principal had absconded and the Demand therefore cod not be made by him.
Judgment for the Plaintiff
Damages – 1216 Sicca Rupees, being the Sum which now remaind unpaid.
