William Bondfeild, and Philadelphia his Wife, late Widow and Executrix of Alexander Jephson.

This was an Action to recover One Hundred and Seventy Two Pounds or there about for which Jephson had given to Mr. Whittall a promissory note or bill of Exchange: The Defendants had pleaded payment of about two Thousand Rupees to some Person to whom Jephson was indebted; and further that while Philadelphia was the Widow of Gallopine, Jephson had bought of her a house, for forty thousand Rupees, and had given a bond to Yates and Grosse, in the Penalty of eighty thousand to them as trustees for her: and that afterward on the treaty of marriage between Jephson and Philadelphia, this bond was recited in the Marriage Articles and agreed to be holden by the same Trustees in Trust for the sole and separate use of the
