Before I came upon the bench a cause was called on & adjourned for further trial the title of which was Manick Mestiere v. Madub Goody; & then began – Ramhurry Nundy &}

which was an action on sevl ordinary counts brot to recover a sum of money pd by Plfs to deft, on condition that he shod procure them a release from a 3d person to whom they were indebted in the like Sum, which condition he (as they said) had not performed. It came out in evidence that they were ptners with that 3d person & had only pd to Sookmoy a joint debt of the partnership; whereupon just after I came upon the bench Plf was nonsuited.
