on shewing Cause, affidavits were produced that the complainant had all the time to the present day, resided at Calcutta, although he some times went to Serampore and staid there two or three days. One of those who swore was the owner of the House where the complainant lived, who swore that he saw him in that House every three or four days, but it was insisted, that because the Complainant had not sworn himself, the other deponent should not be beleived but the rule should be made absolute.
