The board, on having their minute re’d again, appear not to have ratified any promise given by the Governor-General, but make a promise under Conditions, which Conditions Major Balfour among others refused, and therefore, they are not bound by this Voluntary offer.
I am therefore of Opinion there must be a Decree for the Company.
