Oct. 5th adds to the Risk.
Mr. John Fergusson gave Evidence that in his Opinion it was no Deviation from the Voyage from Calcutta to Madras to go to Masulipatam unless the words were to Madras direct.
But Mr. Cudbert Thornhill and Mr. Joseph Price gave evidence that it was a deviation: And the Court were convinced by their Evidence and there was judgment for the Plaintiff for the Penalty of the Bond.
